These Terms of Service govern your access to and use of the drammr website and mobile application operated by Marshall Spirits, Ltd. ("drammr", "we", "us", or "our"). drammr is a community platform for creating sensory profiles for spirits, sharing tasting notes, and interacting with other users.
By accessing or using drammr, you agree to be bound by these Terms. If you do not agree, you must not use the service.
You may use drammr only if you are legally permitted to do so.
You may need to create an account to access some features of drammr.
You retain ownership of the content you submit to drammr, including tasting notes, ratings, comments, profile information, and photos.
By submitting content to drammr, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, publish, display, and distribute that content solely as needed to operate, improve, promote, secure, and moderate the service.
You are solely responsible for the content you submit and for ensuring that you have all rights, permissions, and consents necessary to submit it.
You must not misuse drammr. In particular, you must not use drammr to submit, share, or engage in content or conduct that is:
We may review, moderate, remove, restrict, or refuse content, and we may suspend or terminate accounts, where we reasonably believe it is necessary to enforce these Terms, comply with law, protect users, investigate abuse, or safeguard the integrity of drammr. We are not obliged to monitor all content, but we may take action when we become aware of issues.
drammr, including its software, branding, logos, text, design, and underlying technology, is owned by or licensed to Marshall Spirits, Ltd. and is protected by intellectual property laws. These Terms do not give you any ownership rights in drammr other than the limited right to use the service in accordance with these Terms.
drammr may rely on third-party platforms and infrastructure, including mobile app stores, hosting, authentication, analytics, and cloud providers. Your use of those third-party services may also be subject to their separate terms and policies, and we are not responsible for third-party services that we do not control.
We may change, update, suspend, or discontinue any part of drammr at any time, including features, functionality, or availability. We will try to act reasonably, but we do not guarantee that drammr will always be available, uninterrupted, secure, or error-free.
To the fullest extent permitted by applicable law, drammr is provided on an "as available" and "as is" basis. We do not make any promise or warranty that the service will meet your requirements, that user content will be accurate or reliable, or that defects will always be corrected.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights. Subject to that, we will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, goodwill, data, or opportunity arising from or connected with your use of drammr.
You may stop using drammr at any time and may delete your account using the available in-app tools. We may suspend or terminate your access to drammr if you breach these Terms, create risk for users or the service, or where we are required to do so by law.
Our Privacy Policy explains how we collect, use, and protect personal data in connection with drammr. By using drammr, you acknowledge that your personal data will be handled in accordance with that policy.
These Terms are governed by the laws of England and Wales, except to the extent that mandatory consumer protection laws in your country of residence apply and cannot be excluded by agreement. The courts of England and Wales will have jurisdiction unless applicable law gives you the right to bring a claim in another competent court.
